A Power of Attorney allows another trusted person or people to manage your affairs on your behalf in the event of your future incapacity.
The Power of Attorney usually covers financial matters and decisions regarding your health and welfare.
These days it is not usually possible for a relative, even a spouse, to manage your affairs without legal authority to do so. A Power of Attorney therefore gives your Attorney the necessary legal authority, without having to go through the much more complicated and expensive Guardianship process.
An Attorney must act in your best interests. The Power of Attorney gives the Attorney a legal voice to make sure your interests are looked after.
It is essential that a Power of Attorney is put in place whilst you still have mental capacity. We therefore recommend you consider arranging a Power of Attorney at the same time as you arrange your Will.
